Terms of service

Last updated October 13, 2026

These terms are an agreement between you and Seth Davis ("we", "us"), who runs FreshVisit. By creating an account or using FreshVisit, you agree to them. If you use it for a company, you agree for that company too.

The service

FreshVisit drives a real browser through websites you choose, captures what it sees, and reports on it. It's in early access: features, limits, and plans will change, and we may add, change, or remove parts of it. We'll give notice of changes that take away something you pay for.

Your account

Give accurate details, keep your password and access keys safe, and tell us if you think someone else is using your account. You're responsible for what happens in it, including what people you invite to a workspace and the AI assistants you give an access key do there.

Sites you point it at

You choose where FreshVisit goes, so you're responsible for having the right to go there. In particular, you agree not to:

  • Use it on a site whose terms forbid automated visits, unless you have permission.
  • Sign in to a site with an account you aren’t allowed to use. Use a test account on your own site wherever you can.
  • Use it to get around logins, paywalls, CAPTCHAs, or other access controls, or to overload a site.
  • Collect personal data from sites, or use what it captures in a way that breaks the law or someone else’s rights.
  • Interfere with the service, get around its limits, or resell it without our permission.

We may stop a run, or suspend an account, that breaks these rules or puts the service or a site at risk.

Your content

What you put in (addresses, goals, settings) stays yours. You let us store, process, and show it, and what your runs capture, only to run the service for you and the people you share it with. Screenshots and text captured from websites belong to those websites' owners; you're responsible for how you use and share them. A share link makes its page visible to anyone who has the link.

What the results are

Runs are automated, and an AI model decides where to click and whether a goal was reached, so results can be wrong. A findability score is our measure, not a guarantee of how real visitors behave. Accessibility checks catch only part of what WCAG covers and don't certify that a site is accessible or compliant. Check anything important yourself before relying on it.

Plans and billing

The Free plan costs nothing. Paid plans are monthly subscriptions sold through Polar, our payment provider and merchant of record, so your purchase is also covered by Polar's terms. A subscription renews each month until you cancel. You can cancel any time from Manage billing; you keep the plan until the end of the month you paid for, then move to Free, and your work stays. We may change prices, with at least 30 days' notice before a change applies to you. If something went wrong with a charge, email help@contact.freshvisit.app. Each plan's runs and limits are on the pricing page.

Ending

You can delete your account any time in Settings. We may suspend or close an account that breaks these terms, and we'll tell you why unless the law or safety stops us. If we ever shut FreshVisit down, we'll give at least 30 days' notice and refund any time you've paid for and won't get.

No warranty

FreshVisit is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that it will be uninterrupted, error-free, or fit for a particular purpose.

Limits on liability

To the extent the law allows, we aren't liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim about FreshVisit is limited to the greater of what you paid us in the 12 months before the claim and $100.

You agree to cover our costs from claims brought by others over the sites you pointed FreshVisit at, or your use of it in breach of these terms.

Law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and any dispute goes to the state or federal courts in State of Texas. If a part of these terms can't be enforced, the rest still applies.

Changes and contact

We may update these terms. If a change matters, we'll update the date above and email signed-up users before it takes effect; using FreshVisit after that means you accept it. Our privacy policy explains how we handle your data. Questions: help@contact.freshvisit.app.
